We've tried to keep these T&Cs as simple possible as we want you to be very clear about our conditions of trade. Please read carefully.

 

Gilly’s Balloon Co is the online trading name of Gilly’s Balloon Company. Registered trading address 175a Hallgate, Cottingham, HU16 4BB.

By placing an order with us you will be deemed to have read, understood and agreed to the following Terms and Conditions so please read carefully. The terms do not affect your statutory rights.

CONTRACT

Your contract for purchases made through www.gillysballoons.co.uk is with Gilly’s Balloon Co. Your submission of an order represents an offer to purchase by you and it is not contractually binding on us until we have accepted your order by dispatching your product(s) to you. This means that:

All the details that you provide to Gilly’s Balloon Co for the purpose of purchasing products must be true, accurate, current and complete in all respects and if requested by us you must provide, within a reasonable time frame, enough information to allow us to check the accuracy and validity of any information supplied by you, or your identity. If we suspect that you have engaged in or are about to engage in fraudulent or illegal activity Gilly’s Balloon Co holds the right to cancel your order.

You agree that if you break these conditions you will be responsible for the costs and expenses that Gilly’s Balloon Co incurs as a result of the breach, including reasonable legal fees (if applicable). You will remain liable if someone else uses your shopping account and/or personal information unless you can prove that such use was fraudulent.

PRIVACY & SECURITY

Your Personal Information - its use & storage

Whenever you supply any personal information to Gilly’s Balloon Co we have a legal obligation towards you in how we deal with that data.

We want you to be very clear about what information we collect and why we collect it. We collect your personal information in four different ways, for four different purposes:

Delivery or Click & Collect: When you place an order with us we collect your name, address, email address and telephone number. This information is purely used to deliver your order and keep an order history for you. We do not share this information with any third parties or for any other purposes. You can at any time request that we permanently delete your information and you can do this by calling: 01482 847007 or emailing sales@gillysballoons.co.uk. This information is then removed from our data base and permanently delete from our website server.

Payment: When you place an order with us we have to collect financial details such as card number, expiry date and CVS number. We do not handle or hold any of this information. Any financial information is handled and held by our Merchant Bank. You will see our Badge of Trust on our Payment Page which means that we have had to demonstrate that we adhere strictly to SSL Secure Shopping security and legal requirements.

Cookies: Statistics about visitors to the Gilly’s Balloon Co website are collected using Cookies by a software program called Google Analytics which registers visitor numbers, visitor locations, referral sites etc from which users are accessing our website. All websites use Cookies. They do not collect any personal information and are completely anonymous. You can read in full about Cookies and our Security Policy regarding them below.

Access to your personal information
You have the right to request a copy of personal information held about you by Gilly’s Balloon Co and SSL Secure Shopping. Please address these requests to sales@gillysballoons.co.uk and we will be happy to help.

PLACING AN ORDER

Once you have placed an order with us we will send you a confirmation that your order has been received but this is not a confirmation that your order has been accepted. If a product is incorrectly priced or incorrectly described Gilly’s Balloon Co is not obliged to sell you that product but will immediately refund any payment made in full. If Gilly’s Balloon Co does not have enough stock to accept your order you can request that we notify you as soon as stock is available. Gilly’s Balloon Co is not able to accept payment for advance orders. Your credit/debit card account will be authorised when your order is placed and payment taken. If for any reason Gilly’s Balloon Co is unable to fulfil your order you will be contacted, at latest by the next working day, and refunded in full.

PRICES

Prices are subject to change without notice but all prices quoted on this website are accurate at the time of publication. Prices are quoted in pounds sterling and where appropriate are inclusive of UK sales tax (VAT) at the current rate.

PAYMENT

We accept the following methods of payments:

All credit and debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.

DELIVERY

You can select your preferred delivery date and time when placing your order but please note that all dates quoted for delivery are estimates and may be subject to change.

PROMOTIONAL CODES

We may from time to time offer promotional discount codes. The conditions of use relating to any discount code will be specified at the time of issue. Only one promotion code can be used per order. A promotion code can't be used after an order has been placed. Promotional codes and offers cannot be used on sale products.

RETURNS & EXCHANGES

On the rare occasion that your purchase is not quite right, we will strive to correct this for you. Your order is only eligible for exchange or return if the delivery does not match the original order and a prearranged alteration was not discussed and agreed.

We take every care to ensure that the description, specification and photos of our balloons are correct. These are intended only to give a general impression of the balloons and are not binding. This means, for example, that the colour reproduction of the products is only a close representation and we cannot accept any responsibility for any variation in colour caused by the browser software or computer system used to view the products.
